The rates, rules and regulations named in this tariff apply for local transportation by motor vehicle on shipments in interstate or foreign commerce from, to, and/or between points subject to the operating authorities set forth in the governing scope of operations.

This tariff is governed, except as otherwise provided herein, by the following described publications (series) including supplement thereto or reissues thereof:

2. Rules and Regulations Tariff 5, issued by Clipper Exxpress Co.

MC-161489 Over Irregular Route Transporting General Commodities (Except household goods and commodities in bulk). Between points in the United States (except AK & HI).

When a contract exists between customer and carrier, rates issued under contract will supercede the rates published herein.

An additional charge will be applicable to each additional stop to pickup partial shipments or to partially unload enroute to actual billed destination. An additional stop is defined as a pickup or delivery point not including the original origin and final destination. First Stop - $75.00 Second Stop - $100.00 Third Stop - $125.00 Fourth or more Stop - $150.00 each

This item applies when Customer tenders Clipper Exxpress Co. a load and subsequently cancels the order when the driver has already been dispatched. Charge to customer will be $250.00

This item applies when Clipper Exxpress Co. driver with tractor and trailer is delayed or detained on the premises of consignor or consignee. To become eligible for this charge:

1. Clipper Exxpress Co. must arrive at the consignor or consignee before or within the prearranged appointment day and time
2. Clipper Exxpress Co. allows consignor or consignee 1 hour free time (Free time is determined by taking the greater of the actual arrival time by the driver or the start of the appointment window and allowing 1 hour from that time), and
3. After the one hour (Free time) has passed, Clipper Exxpress Co. will charge the following: Free/1 hours 2nd hour - $75.00 3rd hour - $100.00 4th & more - $125.00 per hour Layover Charge - $250.00 per day

This item applies when Customer notifies Clipper Exxpress Co. of a change in consignee location of the shipment while Clipper Exxpress Co. is in the process of transporting the loaded trailer to the original consignee. Clipper Exxpress Co. is allowed a flat charge of $100.00 and at the applicable rate negotiated from origin to final destination via the point of diversion or reconsignment.

This item applies when Customer requires Clipper Exxpress Co. to use their driver to load the shipment into the trailer at consignor or unload the shipment at the consignee. When carrier is required to load and/or unload, or when driver is required to assist with loading and/or unloading, the charge assessed will be the actual cost (Lumper charges), subject to a minimum of $125.00 per service. (Receipts to be provided).

A Diesel fuel surcharge will be applied to net freight bill charges when the U.S. National Average Fuel Index (*NAFI) reaches minimum per gallon cost shown below. Fuel surcharge will be applicable every Tuesday after the National Fuel Index is published. The National DOE Fuel Index number is 202-586-6966.

Penalty fee of $250.00 will be assessed in the event a driver is dispatched, by the shipper to a destination not authorized by Clipper Exxpress Co.

$125 charge will apply for commodities specified by DOT as hazardous.
